1. About Our Services

Learner Happiness provides happiness data analysis and benchmarking services for UK educational institutions. We analyze learner survey data to identify happiness drivers, stress factors, and safety concerns, creating comprehensive reports and insights for school and college leaders.

2. Our Services Include

• Learner happiness survey data analysis

• Identification of happiness drivers and stress factors that impact learners

• Assessment of safety concerns affecting learner happiness

• Institutional benchmarking against peer schools and colleges

• PDF report with actionable insights on happiness improvement

• Safeguarding compliance analysis related to learner happiness

• Anonymous data aggregation and comparison

3. Data Privacy and Protection

• We only report on groups of 10 or more learners to protect individual privacy

• All personal data is handled in accordance with UK GDPR requirements

• We implement appropriate technical and organizational measures to protect your data

• Individual learner responses remain confidential and are never shared in identifiable form

• Data retention: Survey data is retained for 7 years for longitudinal research purposes, after which it is securely deleted

• Data location: All data processing occurs within the UK/EU

• Joint data controllers: We act as joint data controllers with educational institutions under UK GDPR

Data We Collect:

• Anonymous survey responses about educational experience and wellbeing

• Year group/age information for demographic analysis

• Gender identity (optional field - students may skip)

• Institution identification for generating institution-specific reports

Data We Do NOT Collect:

• Student names or contact details

• IP addresses or device identifiers

• Any information that directly identifies individual students

4. Third-Party Data Processors

We use QuestionPro as our survey platform. QuestionPro is:

• ISO 27001:2022 certified

• GDPR compliant with EU data hosting

• SOC 2 audited

QuestionPro acts as a data processor under our instructions and does not use survey data for any purpose other than providing survey services to us.

5. Academic Partnerships

We share anonymised, aggregated results with the London School of Economics (LSE) for educational research purposes, unless stated otherwise in individual data sharing agreements with your institution.

This data:

• Contains no personally identifiable information

• Is used solely for educational research purposes focused on learner happiness

• Helps improve understanding of happiness drivers and stress factors in educational settings

• Cannot be traced back to individual learners or specific institutions

• Is governed by separate research ethics and data protection agreements

Institutions may opt out of LSE data sharing by specifying this in their service agreement. No other academic partnerships involve data sharing without explicit institutional consent.

6. Data Analysis Methods

• All analysis is conducted using secure internal tools and statistical methods

• Data is processed locally using professional analysis software

• No external AI tools are used for analysing survey data containing personal information

• All processing maintains student anonymity and data protection standards

7. Data Breach Notification

In the unlikely event of a data breach that poses a risk to learner rights and freedoms, we will:

• Notify the ICO within 72 hours of becoming aware of the breach

• Notify affected institutions without undue delay

• Take immediate steps to contain and remediate the breach

8. Limitation of Responsibility

Important: Learner Happiness does not accept responsibility for:

• Any decisions made based on our analysis or reports

• The outcomes or results of actions taken using our insights

• Any consequences arising from the implementation of our recommendations

Our reports provide data analysis and insights on learner happiness, stress factors, and safety concerns only. All decisions regarding learner happiness interventions and safety measures remain the responsibility of the educational institution and its qualified staff.

9. Safeguarding and Concerns

We flag safety concerns and happiness-related issues that we believe are worthy of attention based on our data analysis. However:

• Our flagging system for safety concerns and happiness indicators is for guidance only

• It does not replace professional judgment or institutional safeguarding procedures

• Educational institutions remain fully responsible for their safeguarding obligations and learner safety

• Any urgent concerns affecting learner safety or happiness should be addressed through proper institutional channels

10. Data Subject Rights

Students and parents have rights under UK GDPR including:

• Right to information about data processing

• Right to access personal data (limited due to anonymous nature)

• Right to object to processing

• Right to request deletion

• Right to complain to the Information Commissioner's Office

11. Service Availability

We aim to provide reliable service but cannot guarantee:

• Uninterrupted access to our insights (these are sent around 7 days after all surveys are completed)

• Error-free analysis (though we strive for accuracy)

• Specific timeframes for report delivery unless explicitly agreed

12. Intellectual Property

• Our analysis methods, benchmarking algorithms, and report formats remain our intellectual property

• You may use our reports internally within your institution

• Our reports may not be redistributed or shared with third parties without permission

13. Payment and Cancellation

• Payment terms will be agreed separately for each service

• Cancellation policies will be specified in individual service agreements

• Refunds are considered on a case-by-case basis

14. Data Deletion Rights

Educational institutions may request deletion of their survey data at any time. We will:

• Comply with deletion requests within 30 calendar days

• Securely delete data from all systems and backups

• Provide confirmation of deletion upon request

15. Changes to Terms

We may update these terms occasionally. Continued use of our services after changes constitutes acceptance of the updated terms. Significant changes will be communicated in advance where possible.

16. Governing Law

These terms are governed by UK law and any disputes will be subject to the jurisdiction of UK courts.
